1. Let affidavit of service, as filed in Court, be kept on record.
2. The petitioners are aggrieved by the acts of commission and/or omission of the respondent Bank.
3. Petitioners have challenged such action of the Bank, which is pending adjudication before the Debt Recovery Tribunal-III.
4. Petitioners are at liberty to approach the Bank with a fresh proposal for a one time settlement. Let such proposal be made by February, 10,
2026.
5. Mr. Chowdhury, learned Advocate appearing for the respondent Bank, submits that even though earlier proposals have been considered, the Bank is willing to consider a fresh proposal, if the same
2 is filed by February, 10, 2026. The Bank will dispose of such proposal of the petitioners by February 15, 2026. This attempt to settle the matter is without prejudice to the rights and
contentions of the parties, particularly the pending application before the Debt Recovery Tribunal, made by the petitioners.
6. With the aforestated directions, the writ petition is
disposed of.
7. There shall, however, be no order as to costs.
8. Urgent photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
