p. 1 IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No.2345 of 2026 (1) Tukuna Parida (2) Susanta Kumar Parida @ Bapuji Parida @ Susanta Parida …. Petitioner(s) Mr. Amitav Tripathy, Advocate -versus- State of Odisha and another …. Opposite Party(s) Mr. Aurobinda Mohanty, ASC CORAM: JUSTICE SIBO SANKAR MISHRA Order No. ORDER 21.04.2026 01. 1. Heard. 2. The petitioners are seeking pre-arrest bail in connection with Nuagaon P.S. Case No.227 of 2025 corresponding to Special G.R. Case No.73 of 2025 for commission of offences under Sections 126(2)/115(2)/74/76/78/3(5) of B.N.S., 2023 read with Section 12 of the POCSO Act pending in the Court of the learned Additional Sessions Judge-cum-Special Court under POCSO Act, Nayagarh. 3. The prosecution case, in brief, is that the informant lodged a written report before the Police p. 2 alleging, inter alia, that on 13.10.2025 at about 5:30 P.M., while she was proceeding on her bicycle from her uncle’s house to attend tuition, the present petitioners wrongfully restrained her and assaulted her. It is further alleged that the petitioners had subjected her to similar acts of harassment on two prior occasions. 4. Mr. Tripathy, learned counsel for the petitioner at the outset submits that the co-accused persons have already surrendered and admitted to regular bail. Hence, he will resort to the same remedy before the court below. Since the co-accused persons have already granted bail, he fairly submits that his client would surrender before the learned trial Court on or before 10th May, 2026 and move for regular bail. 5. Regard being had to the submission of learned counsel for the petitioners, liberty is granted to the petitioner to surrender before the learned trial Court on or before 10th May, 2026 and move application for regular bail. It is open for the petitioners to urge the point of parity. If they surrender and move application for bail, it is expected that the learned trial Court shall p. 3 dispose of the bail application on the same day by considering the ground of parity. 6. With this observation, the ABLAPL is disposed of. (S.S. Mishra) Judge Swarna
