This is the second bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicants who are apprehending their arrest in connection with Crime No.37/2026 registered at Police Station – Ambikapur, District- Surguja (C.G.) for the offences punishable under Section 296, 351(3), 115(2), 331(5), 324(4), 309(6), 3(5) of VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.03.16 17:42:05 +0530
2 BNS, 2023. 2. The applicants had preferred a first bail application bearing MCRC No.294 of 2026, which was dismissed for want of prosecution vide order dated 23.02.2026. 3. Facts of the case are that the complainant Upendra Kumar Gupta lodged report at Police Station, alleging therein that he is running vegetable shop at Dullu Vegetable Market and nearby the shop of complainant, the shop of accused Rajendra Gupta is also situated in the name of Maa Sherawali Vegetable Store. On 20.01.2026 the accused Rajendra Gupta has purchased the Suran vegetable from the customer of complainant and thereafter he sold the Suran vegetable to other person in more rate and when the complainant asked the accused Rajendra Gupta that how he has purchased the vegetable from the customer of complainant, then the said Rajendra Prasad Gupta and his son Priyanshu Gupta started abusing to the complainant with filthy language and when the complainant and his relatives opposed the accused, then they started assaulting with the complainant and his relatives and also damaged the electronic weighing machine of complainant. On the basis of said report, the alleged offences have been registered against the applicants and other co-accused. 4. Learned counsel for the applicants submit that applicants are innocent and have falsely been implicate in this case.
He also submits that applicants had preferred a first bail application bearing MCRC No.294 of 2026, which was dismissed for want of
3 prosecution vide order dated 23.02.2026. He also submits that applicants and complainant are neighbors, both are running vegetables shops adjacent to each other. Due to some business competition, there was scuffle took place between the complainant and his family members and both parties are registered FIR against each other. It is further contended that conclusion of trial as well as investigation is likely to take some time, therefore, he prays for releasing the applicants on anticipatory bail. 5. On the other hand, learned State counsel opposes the bail application and submits that applicants have no criminal antecedents and injuries revived by the injured are simple in nature. 6. I have heard learned counsel for the parties and perused the case diary. 7. From perusal of the records, it transpires that injuries sustained by the injured are simple in nature, a counter FIR has also been lodged, therefore, I am inclined to grant anticipatory bail to the present applicants. 8. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant No.1 – Suraj Gupta and applicant No.2 –Ankit Soni, on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:-
4 (a) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) The applicant and the surety shall submit a copy of their adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
(e) The applicant shall not involve himself in any offence of similar nature in future. Sd/- (Ramesh Sinha)
