Parashar, learned Additional Public Prosecutor for the State. 2. This application has been filed under Section 483 of the Bharatiya Nagarik Suraskha Sanhita, 2023, whereby the petitioner Abdulla Ali @Obey has prayed Page No.# 2/3 for bail as he is behind bars since 22.05.2026 in connection with Basistha Road P.S Case No. 162/2026 registered under Section 303(2) of BNS. 3. I have considered the submissions at the Bar. 4. It is submitted that the petitioner is alleged with an offence of theft of 2 heads of cattle. 5. It is submitted that investigation may have progressed by now as the petitioner is behind bars since 22.05.2026. 6. It appears that bail may be granted to the petitioner as investigation may have presumably progressed to some extent. The petitioner is a local resident and he is not a flight risk. The petitioner is willing to co-operate with the investigation. 7. In view of the foregoing discussions, the petitioner is enlarged on bail of Rs.30,000/- (Rupees Thirty Thousand only) with a suitable surety of like amount subject to the satisfaction of the learned Jurisdictional Court/Elaka Magistrate under the following conditions: (i) the petitioner shall refrain from such activities with which he is alleged; (ii) (ii) the petitioner shall appear before the I.O. on every fortnight till completion of the investigation; and (iii) (iii) the petitioner shall not try to influence the witnesses or tamper with the evidence. 8. On breach of any of the bail conditions, the court is at liberty to immediately Page No.# 3/3 cancel the bail granted to the petitioner. 9. Accordingly, the bail application stands disposed of.
