JUSTICE MRIDUL KUMAR KALITA ORDER 22.06.2026 [1] Heard Mr. A.K. Gupta, the learned counsel for the applicant. Also heard Mr. M. Dutta, the learned senior counsel, assisted by Ms. S.P. Roy, the learned counsel for the respondent No. 1 as well as Mr. S. Pegu, the learned counsel for the respondent No. 5. [2] This interlocutory application has been filed by the applicant/claimant, in connection with MAC Appeal No. 10/2025, praying for issuance of a direction for release of the 50 % of the awarded amount which has been deposited by the applicant/opposite party No. 1 before the Registry of this court, in pursuant to order dated 10.01.2025, passed in I.A.(C) No. 73/2025 in connection with MAC Appeal No. 10/2025. [3] The learned senior counsel for the insurance company submits that since in the connected appeal, the insurance company has questioned the quantum of the compensation awarded to the claimants in the event this interlocutory application is allowed and undertaking may be taken by the claimants/opposite party that if required they shall deposit back the amount before the court, if so directed. Page No.# 3/3 [4] I have considered the submissions made by the learned counsel for both sides. [5] Considering the averments made in this interlocutory application as well as submissions made by learned counsel for both sides, the prayer for release of 50 % of the awarded amount, which was deposited by the insurance company, to the claimants is allowed. [6] The Registry is directed to disburse the 50% of the awarded amount which was deposited by the appellant/insurance company before it in pursuant to the order of this court after proper verification, subject to submitting of an indemnity bond to the extent of amount to which he is to be released to the claimants/opposite party.
