Also heard Mr. R.R. Kaushik, learned Additional Public Prosecutor appearing for the State. This is an application under Section 482 of the BNSS, 2023, praying for grant of pre- arrest bail to the accused/petitioner, Sahad Ali Sheikh @ Sayed Ali, who is apprehending arrest in connection with PRC No.448/2025 under Section 120(B)/364A IPC arising out of Dhubri Page No.# 2/3 P.S. Case No.176/2024 pending before the Court of Sub-Divisional Judicial Magistrate(S), Dhubri. An FIR was lodged as Dhubri P.S. Case No.176/2024 on 25.05.2024, inter alia alleging that the accused persons had entered the room of the informant and physically confined them and demanded a huge amount of money and subsequently after some negotiation, an amount of Rs.1,95,000/- was paid to the Bangladesh bank account of the accused persons. However the informant managed to escape from the clutches of the accused persons and lodged the FIR. The case has ended in charge-sheet, wherein, the present petitioner has also been named. It is submitted on behalf of the petitioner that there is no specific allegation against him mentioned in the charge-sheet and the case is now pending for appearance. It is also apprehended that upon his appearance he would be remanded to custody. It is further submitted by the learned counsel for the petitioner that the petitioner is desirous to face the trial. It also appears that four of the co-accused persons were arrested were subsequently released on bail and the case is ending for appearance of other co-accused persons, who have been shown as absconder. Having regard to the fact that there is no specific allegation against the present petitioner in the charge-sheet and that four of the co-accused persons after being granted bail have been appearing before the learned Court below and also having regard to the interest of speedy trial, it is deemed necessary to allow the prayer for the pre-arrest bail of the petitioner. Accordingly, it is directed that in the event of arrest, the petitioner named above shall be released on pre-arrest bail on furnishing a bail bond of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount to the satisfaction of the Arresting Authority in connection with the aforesaid case. It is further provided that the petitioner shall appear before the SDJM(S), Dhurbi on the next date fixed i.e. on 30.06.2026 and the protection granted by this order shall be inoperative in the event of failure of the petitioner to appear before the Court on the said date save and except for exceptional reasons.
