JUSTICE ANANT RAMANATH HEGDE ORAL ORDER This petition is filed assailing the order dated 15.05.2025 passed by the first respondent granting permission to prosecute the petitioner for violating the provisions of the Industrial Disputes Act, 1947 ('Act, 1947'). 2. Learned counsel for the petitioner-employer and the learned counsel for the respondent No.2-Union jointly submit that the dispute is amicably settled. The joint memo is filed reporting settlement and the same is signed by the authorised signatory of the respondent No.2-Union. 3. The representatives of the petitioner and respondent No.2-Union are present. 4. The joint memo is accompanied by a memo of settlement under Section 12(3) of the Act, 1947 read with Section - 3 - HC-KAR NC: 2026:KHC:9427 WP No. 16486 of 2025 18(3) of the Act, 1947 and Rule 59 of the Industrial Dispute (Karnataka) Rules, 1957. 5. It is submitted that the settlement is arrived at before the Deputy Labour Commissioner and the Conciliation Officer. It is submitted that in view of the settlement referred to above, the Union does not wish to prosecute the petitioner. 6. The settlement is accepted. Hence, the following:- ORDER (i) Petition is disposed of in terms of the settlement. (ii) The impugned order dated 15.05.2025 passed by the first respondent stands quashed.
