Hussain, learned counsel for the petitioner. Also heard Mr. P. Borthakur, learned Addl. P.P appearing for the State. The petitioners herein have invoked the provisions of Section 482 BNSS to seek pre-arrest bail in connection with Dhula P.S. Case No. 127/2025, registered under Sections 189(2)/ 329(3)/109/118(2)/324(4)/324(5) of BNS, 2023. The gist of the allegations in the FIR dated 15.11.2025 is about assault and causing of injuries. As many as 12 accused persons are named in the FIR. The case has already been charge- sheeted vide C.S. No. 51 of 2026 dated 29.04.2026, as reflected in the previous order dated 03.06.2026. The learned Addl. P.P. confirms the completion of investigation. The learned counsel for the petitioners submits that in the meantime, petitioner Nos. 2, 4, 6, and 7, namely, Hazrat Ali, Miraj Ali @ Arej Ali, Faraj Ali and Ohed Ali - surrendered before the learned Court below and sought bail, pursuant to which they were allowed to go on bail. In the context of completion of investigation and the aforesaid development pertaining to four of the petitioners herein -this petition is disposed of with the observation that the petitioners shall appear before the learned Court below and seek regular bail and Page No.# 4/4 necessary orders shall be passed thereon, keeping in mind the aspect of completion of investigation and also aspect of parity. A copy of this order shall be placed by the remaining petitioners, before the learned Court below. Till their appearance before the learned Court below, the remaining petitioners herein, namely Hazrat Ali, Miraj Ali @ Arej Ali, Faraj Ali and Ohed Ali shall not be subjected to coercive action, in this case.
