No. 696 of 2026 __________ Page3 of 8 within the radius of 500 meters from petitioners factory premises namely J.K.Tyre and Industries Ltd., Chennai Tyre Plant Sriperumpudur Taluk, Kancheepuram District, pursuant to the complaint of the petitioner dated 17.03.2026. 2. The petitioner is a tyre manufacturing company and the factory is situated in Kolathur Village, Sriperumbudur Talk and it is functioning from February 2012. The factory employed more than 1000 persons including permanent workmen, trainees and probationers. Settlements have been entered periodically with the third respondent and the last settlement was signed on 26.04.2022 and it expired on 31.03.2025. Upon expiry of the said settlement, the third respondent union submitted its charter of demands seeking revision of wages. Despite continuous engagement of the petitioner management in collective bargaining and negotiations, as no agreement could be reached regarding wage revision, the dispute was taken up for conciliation before the Deputy Commissioner of Labour and the conciliation proceedings is pending. While so, the third respondent union issued a strike notice on 02.03.2026 and thereby attempting to exert unlawful pressure on the petitioner and the third respondent union and its members may obstruct ingress and egress of employees, vehicles and materials and disrupt the normal functioning of the factory. Earlier, as similar strikes have been held obstructing ingress and egress of employees, vehicles and materials and disrupted normal functioning of the https://www.mhc.tn.gov.in/judis WP Crl. No. 696 of 2026 __________ Page4 of 8 factory, the petitioner had filed a suit in O.S.No.79 of 2017 and the suit has been decreed in favour of the petitioner for permanent injunction on 05.12.2020. Despite the injunction decree, as the third respondent union members continued to resort to illegal strike, a Writ Petition in W.P.No.31355 of 2022 has also been filed and this Court by an Order 23.11.2022 had directed the respondent police to do needful for free ingress and egress of the workmen and vehicles from and out of the factory. Since, the third respondent has again issued strike notice, the petitioner had sent complaint to the first and second respondents. However, the same has not been considered by them. Hence, the present Writ Petition. 3. The learned Additional Public Prosecutor would submit that the complaint of the petitioner dated 17.03.2026 is under consideration and the same will be considered by the second respondent. 4. A perusal of materials available on record reveals that earlier the petitioner had moved this Court for a similar relief in W.P.No.31255 of 2022 and this Court by an Order dated 23.11.2022 had passed the following Order : “7. Since the petitioner had already got a judgment in his favour for permanent injunction by restraining the fourth respondent and its workmen from demonstrating strike or similar such activities within the radius of 500 meters from the https://www.mhc.tn.gov.in/judis WP Crl. No. 696 of 2026 __________ Page5 of 8 factory premises and preventing obstruction of free flow of vehicles in and out of the petitioner premises, it shall be obligatory on the part of the respondent police to ensure the same by doing the needful in accordance with law. Since the respondents 1 to 3 have already been directed to provide police protection, the respondents 1 to 3 shall do the needful for the free ingress and egress of the workmen and vehicles from and out of the factory, by considering the representation of the petitioner dated 17.11.2022 as expeditiously as possible and issue appropriate orders suiting to the demand of the situation. 8. With the above direction, this Writ Petition is disposed of. Consequently, connected miscellaneous petition is closed.” 5. Considering the fact that under similar circumstances as this Court had passed the above Order, this Court is of the view that same Order has to be followed and the respondent shall consider the complaint of the petitioner dated 17.03.2026 and ensure free ingress and egress of the workmen and vehicles from and out of the factory, in line with the Order passed by this Court in W.lP.No.31255 of 2022, dated 23.11.2022. https://www.mhc.tn.gov.in/judis WP Crl.
