2. This is an application under Section 483 of the BNSS, 2023 whereby the petitioner Arfan Ali has prayed for releasing him on bail after he was arrested in connection Gohpur P.S. Case No.04/2026, under Sections 61(2)/308/316(2)/318(4) of BNS, 2023.
3. Initially, one unknown person from Assam rang up the mobile number of the informant. The caller identified himself to be Rahul. He claimed that while doing excavation work, he found 1 kilogram of gold. Rahul told the informant that he wanted to sell the gold. The informant sent his friend Pramod Yadav to Assam. Pramod Yadav was given a sample of the said gold and he took it to his home town at Maharashtra. It
was
found
that
the
gold
was
genuine.
Therefore, the informant started communicating with Rahul. The informant managed to collect 27 lakhs of rupees and with the said money, he came from Maharashtra to Assam. Here, Rahul and his driver Dipu Gogoi took the informant to Gohpur where, the informant met 2 to 4 other persons also. One of the strangers identified himself as Jafar and told that the other person is a dumb person. The gold was handed over to the informant. Twenty Seven lakhs of rupees was also handed over. Later on, it was discovered that it was actually brass, not gold.
4. The Case Diary shows that there are sufficient incriminating materials against the present petitioner Arfan Ali. Therefore, the bail application of the petitioner is rejected and disposed of accordingly.
