THIS PETITION, COMING ON FOR REPORTING SETTLEMENT, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court calling in question proceedings in C.C.No.11826/2023 registered for the offences punishable under Sections 354(A) and 509 of the IPC. 2. Heard Smt. Sumathi Paulin M., learned counsel appearing for the petitioner, Sri. Channappa Erappa, learned HCGP appearing for respondent No.1, Sri. Mohammed Ali R.K., learned counsel appearing for respondent No.2 and have perused the material on record. - 3 - HC-KAR NC: 2026:KHC:21313 CRL.P No. 10578 of 2023 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application along with the joint memo, joint affidavit and compromise deed. The joint memo, joint affidavit and compromise deed so filed read as follows: “JOINT MEMO The counsel for petitioner and respondent No.2 submits that since the respondent No.2 and the petitioner have arrived at settlement by way of compromise deed dated 18/03/2026, the criminal case pending against the petitioner in CC No. 11826/2023 on the file of I Addl. ACJM Bangalore for an offence under Section 354A and 509 IPC, may be kindly quashed in the interest of justice and equity. JOINT AFFIDAVIT We Harish Raju S/o Purushotham aged about 54 years, R/at Room No. 703, Varsha Apartments, Sadashivnagar Bangalore - 560 080 and Dr. Shree W/o Dr. Yogadipathy aged about 36 years R/at Door No. 701, Varsha Apartments, 7th floor, Sadashivnagar Bangalore 560 080 do hereby solemnly affirm on oath as follows : 1. That we are the petitioner and respondent No.2 respectively in the above case. 2. That we have filed petition under Section 359 read with Section 528 of BNSS in order to compromise the case in C.C.No.11826/2023 pending on the file of I Addl. ACJM Bangalore. 3. That what has been stated in the compromise petition from paragraphs 1 to 4 is true and correct. - 4 - HC-KAR NC: 2026:KHC:21313 CRL.P No. 10578 of 2023 4. We affirm that we have no further claims against each other. 5. That what has been stated above is true and correct and we have signed as hereunder.” COMPROMISE DEED This Deed of compromise is entered into between Harish Raju S/o Purushotham aged about 54 years, R/at Room No. 703, Varsha Apartments, Sadashivnagar Bangalore - 560 080 herein called the First Party and Dr. Shree W/o Dr. Yogadipathy aged about 36 years R/at Door No. 701, Varsha Apartments, 7th floor, Sadashivnagar Bangalore 560 080, herein called the second Party on this 18th day of March 2026 Whereas, the second Party had filed a case against the first Party before Sadashivnagar police, Bangalore for an offence under Section 354(A) and 509 of the Indian Penal Code and the same came to be registered vide Crime No.0075/2023 and the police filed chargesheet vide C.C. No.11826/2023 which is pending on the file of I Addl. Chief Judicial Magistrate, Bangalore. The said proceedings has been stayed before the Hon'ble High Court of Karnataka vide Crl. Pet. No. 10578/2023. Whereas the Second Party has agreed to compromise the said matter and both the parties have agreed to file a petition under Section 359 of the BNSS Act to compromise the said matter before the Hon'ble High Court. Whereas on the advice of well-wishers and friends both the parties have decided to arrive at a compromise with regard to the said case Both the parties have herein agreed upon to settle the matter amicably and have decided to file compromise petition before the Hon'ble Court and complete the necessary formalities. - 5 - HC-KAR NC: 2026:KHC:21313 CRL.P No. 10578 of 2023 The first party also confirms that the case before 18th ACJM C C no.6125/2023 has been settled and both parties discharge each other against any future professional, financials, civil or criminal. That by entering into this compromise deed the parties do not have any claim or complaint against each other. Whereas the said compromise is entered into by the parties on their own free will and not under coercion or force by either of the party or any one representing under them. That the compromise deed is irrevocable. Herein witnesseth there of the First Party and Second Party have signed as hereunder" 4. The parties to the lis are present before the Court and are identified by their respective counsel. 5. In the light of application for compounding being filed along with the joint memo, joint affidavit and compromise deed and offences not being against the State, I deem it appropriate to accept the same and terminate the proceedings against the petitioner in the subject petition. 6. For the aforesaid reasons, the following: ORDER i. Criminal Petition is disposed. - 6 - HC-KAR NC: 2026:KHC:21313 CRL.P No. 10578 of 2023 ii.
