The applicant has preferred this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of anticipatory bail, apprehending his arrest in connection with Crime No.294/2025, registered at Police Station Chhuriya District Rajnandgaon (C.G.) for alleged commission of offence GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2026.04.04 13:08:36 +0530 2 punishable under Sections 316(5), 318(4), 336(2), 336(3), 338, 340(2), 61(2) of the Bharatiya Nyay Sanhita, 2023. 2. Case of the prosecution, in brief, is that complainant has lodged the report to the concerned police station stating that under the Pradhan Mantri Fasal Beema Yojana, year 2024-25, in the village of Amgaon in Chhuriya Block, over 50 hectares of land was registered in 34 Khasra in the name of Mr. Jai Bagga, Mr. Vaibhav Goldhha and Mr. Sundarshan Verma, partners of Rallij Bio Energy Private Limited. A banana crop had been cultivated on this land for over a year. Despite this, in the year 2024-25, Fasal Beema Yojana was obtained on the said land by showing a chickpea crop. Without any harvesting or preparation of a Panchnama, and in collusion with Agriculture Department officials, the Patwari and the insurance agent, claims were processed and insurance payouts exceeding Rs. 25 lakhs were wrongfully disbursed by showing loss of a non-existent checkpea crop. The Police Station Chhuriya has lodged the first information report on 12.12.2025 under the Crime No. 0294/2025 for the offence punishable Under Sections 316(5), 318(4), 336(2), 336(3), 338, 340(2), 61(2) of the Bharatiya Nyay Sanhita, 2023. 3. Learned counsel for the applicant submits that the present applicant has falsely been implicated in the aforesaid case, and has not committed any offence. He would submit that only allegation against the present applicant is that he has verified the 3 documents illegally and provided benefit to other co-accused person. He would submit that the present applicant is a reputed person of the society and if he is kept behind the bar then his whole future will be ruined. He would further submit that the applicant is a permanent resident of address mentioned in the cause title and there is no likelihood of absconding, the applicant undertakes to abide by any conditions imposed by this Court, therefore, he submits that the present applicant is entitled to be released on anticipatory bail. 4. On the other hand, learned State counsel has opposed the prayer for grant of anticipatory bail. She would submit that the allegations against the applicant pertains to serious economic offences involving fraudulent verification and illegal transfer of substantial crop insurance amounts into the bank accounts of co-accused persons, therefore the applicant is not entitled for grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the facts & circumstances of the case, submission of learned counsel for the parties, materials available on record, further the fact that allegations against the applicant pertains to serious economic offences involving fraudulent verification and illegal transfer of substantial crop insurance amounts into the bank accounts of co-accused persons, considering the seriousness of 4 the allegations and also considering the fact that investigation is still going on, I am not inclined to grant anticipatory bail to the applicant. 7. Accordingly, the anticipatory bail application of the applicant - Trilochan Prasad Sarthi, involved in Crime No.294/2025, registered at Police Station Chhuriya District Rajnandgaon (C.G.) for alleged commission of offence punishable under Sections 316(5), 318(4), 336(2), 336(3), 338, 340(2), 61(2) of the Bharatiya Nyay Sanhita, 2023 is rejected.
