ORDER The petitioner, who was arrested and remanded to judicial custody on 01.04.2025 for the alleged offences under Sections 8(c) r/w 20(b)(ii)(C), 25 and 29(1) of NDPS Act, 1985 in Crime No.63 of 2025 on the file of the respondent police, seeks bail. https://www.mhc.tn.gov.in/judis

2. The case of the prosecution is that the petitioner along with other accused, was found in illegal possession of 120 kgs of ganja. Hence, a case has been registered against the petitioner.
3. The learned counsel for the petitioner submitted that the petitioner has been falsely implicated in this case and that he has not committed any offence as alleged by the prosecution. He further submitted that the contraband was not seized from the possession of the petitioner. He further submitted that the petitioner has been in custody since 01.04.2025 and is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

The learned Government Advocate (Criminal side) strongly objected to enlarge the petitioner on bail on the ground that the petitioner has one previous case of a similar in nature pending against him. He further submitted that the petitioner hails from State of Orissa, and therefore, there is a possibility of the petitioner absconding if he is enlarged on bail.
5. I have given anxious consideration to the submissions made by the
learned counsel appearing on either side and also perused the materials available on record.
6. From the submissions made by the learned Government Advocate (Crl.Side), it appears that the petitioner has one previous NDPS case to his credit. It is also noted that the quantity of the contraband involved is 120 kgs of ganja, which is a commercial quantity. Therefore, the rigours of Section 37 of https://www.mhc.tn.gov.in/judis
CRL OP No.984 of 2026 __________ Page3 of 4 NDPS Act are applicable. Hence, this Court does not find it desirable to enlarge the petitioner on bail.
