Shahi, AGP Mr. Anubrata Santra ….for the State in WPA 5108/2026 Mr. Ankit Sureka Mr. Biplob Das ….for the respondent Nos.3 to 5 in both the writ petitions Mr. Chittapriya Ghosh Mr. Kuntal Ray Ms. Maitrayee Chatterjee ….for the respondent No.12 in CAN 1/2026 Mr. Dibashis Basu Mr. Uttam Basak ….for the UOI in both the writ petitions Pursuant to the earlier order dated 7th April, 2026, Mr. Nayak, learned advocate appearing for the Co- operative Election Commission, on instructions submits that with a view to comply with the order and directions 2 contained in the judgment and order dated 10th March, 2026, some of the officers of the Co-operative Directorate were entrusted with the duties of holding elections of the Samity on 5th April, 2026. He submits that on the basis of the communication received from the Superintendent of Police, Birbhum District, the Returning Officer had adjourned the holding of the elections. He submits on instructions that those Officers as well as other Officers have now been entrusted with the duties of the Assembly Elections to the State of West Bengal, which is scheduled to be held in two phases on 23rd April, 2026, and 29th April, 2026. He submits that in view thereof, he has been instructed to submit that a date for holding of the elections may be fixed after 29th April, 2026. He also submits that a sufficient notice is to be also given prior to the date of such elections. On a query of the Court, Mr. Nayak, however, submits on instructions that the elections can be held on 10th May, 2026. The learned advocates representing the Superintendent of Police, Birbhum District files a report dated 7th April, 2026 which is taken on record. The said report states that conducting the Election of the Samity at this stage would pose significant challenges in terms of availability of police personnel. The Superintendent of Police, Birbhum District is directed to file a report dealing with the following issues: 3 (i) The date when the letter dated 20th March, 2026, issued by the Returning Officer and the Deputy Registrar of Co-operative Societies, was received by the Office of the Superintendent of Police, Birbhum District; (ii) Whether it would be possible for the Superintendent of Police, Birbhum District to provide necessary police assistance for the purpose of conducting the election of the Samity on 10th May, 2026 as suggested by Mr. Nayak, learned advocate for the Co-operative Election Commission. The Returning Officer of the Samity, being the 5th respondent, is also directed to file a report disclosing their stand on holding of the election of the said Samity. The said report shall also disclose the document in support of the factum of service of memo dated 20th March, 2026 upon the Superintendent of Police, Birbhum District. Let the aforesaid reports be filed by the respondent Nos. 10 and 5, respectively, on or before 10th April, 2026 upon prior service of the same to the learned advocate for the petitioner.
