Government Advocate for the State. 3. The Petitioner is in custody since 27th December, 2025 in connection with Satyabadi P.S. Case No.385 of 2025 corresponding to G.R. Case No.937 of 2025 pending in the Court of learned JMFC-II (Cog Taking), Puri for the alleged commission of the offence under Section 309(4)3(5) BNS. 4. It is alleged that two unknown persons committed theft of mobile phone and cash of Rs.5000/- rupees five thousand from the informant. 5. Learned counsel for the petitioner submits that the co- accused person have already been granted bail. Learned State Counsel opposes the bail by submitting that it is a case of snatching and not theft per se. 6. Considering the nature of accusations the fact that the co- accused has been released on bail and the period of detention already undergone. Let the Petitioner be released on bail on such terms and conditions as the Court below may deem fit and proper Order No. 01. p. 2 to impose including the conditions that he shall personally appear before the trial Court on each date of posting of the case without seeking representation. 7.
