APP … for the State-respondent(s) Learned advocate for the petitioner submits that the owner of the truck has been released on bail in Criminal Appeal No. 34 of 2026 arising out of Special Leave Petition (Criminal) No. 17033 of 2025. The said accused happens to be the owner of the truck from where twenty thousand bottles of phensedyl were recovered. Learned advocate for the State opposes the prayer for bail and submits that the present petitioner was the first driver of the vehicle, as such, the present petitioner is not on the same footing as the owner of the vehicle. However, earlier, there was a direction in respect of the other accused persons to renew their prayer for bail after the seizure list witnesses are examined. 2 The order of the Hon’ble Supreme Court was passed on 5th January, 2026, as such, the earlier orders which were passed by this Hon’ble Court naturally dilutes. Having regard to the fact that at the place of occurrence or at the time of interception of contraband, the present petitioner was not available as also the fact that the present petitioner drove the vehicle to a part within the State of Uttar Pradesh, I am of the view that the petitioner is entitled to the same relief as the other accused person who has been granted bail. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Ravi Kumar shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Judge, Special Court (NDPS Act), Krishnagar, Nadia,. If on bail, the petitioner shall make himself physically available on each and every date so fixed by the learned trial court and shall not leave the jurisdiction of the district of Nadia without prior permission of the learned trial Court. Accordingly, CRM(NDPS) 1690 of 2025 is allowed.
