Impugned in this intra-court appeal is an interlocutory order dated 11.02.2026 passed by the learned Single Judge of this Court [“the writ Court”] in WP(C) No. 830/2023 titled “M/S Tarmac Roads Roof Builders Vs. Union Territory of J&K and Ors.”, whereby the writ Court has directed the appellants herein to deposit an amount of Rs. 1,46,05,785/- before the Registrar Judicial of this Court within a period of six weeks. 02. The impugned order has been assailed by the appellants primarily on the ground that they had already filed objections in the matter which required final consideration by the writ Court. It is contended that, instead of adjudicating the writ petition finally, the writ Court directed the appellants herein to deposit the aforesaid MIR ARIF MANZOOR I attest to the accuracy and authenticity of this document 29.04.26 amount, which, according to the appellants, was unwarranted in the facts and circumstances of the case. It is further submitted that the Union Territory is not a private person likely to dispose of its assets or evade its liabilities in the event of an adverse judgment. 03. In view of the aforesaid, the appeal is allowed and the interlocutory order dated 11.02.2026 passed by the writ Court is set aside. 04. Disposed of along with connected CM(s).
