This is an application under Section 482 of BNSS, 2023 has been filed by the petitioners, namely, Bilal Ahmed Hazari @ Billal Hazari and Sanidul Islam, seeking pre-arrest bail in connection with Dispur P.S. Case No. 173/2026 under Section 126(2)/324(4)/117(2)/303(2)/3(5) of BNS, 2023. 3. The FIR dated 28.03.2026 lodged by Mousumi Aktar by alleging that when she was coming with her husband in their vehicle, the petitioners accompanied by seven miscreants attacked them and assaulted her husband and also her minor son. It is further alleged that they also committed indecent assault upon her. 4. The learned counsel submits that the FIR is concocted and they have been falsely implicated. It is submitted that the husband of the informant had induced some persons including both the petitioners to part with money with promise of job in Water Resources Department and in connection with the same, they have lodged an FIR dated 18.03.2026 before the concerned police station but they came to know that one CID P.S. Case No. 4/2026 has already been registered and investigation is continued. It is submitted that with regard to the same incident, the petitioners have also filed FIR which has been registered vide Dispur P.S. Case No. 174/2026. 5. I have perused the relevant documents. 6. Call for the case diaries pertaining to Dispur P.S. Case No. 173/2026 and Dispur P.S. Case No. 174/2026. 7. However, in the interim, in the event of arrest of the accused- petitioners, named above, shall be released on interim bail in connection with Dispur P.S. Case No. 173/2026 under Section Page No.# 3/3 126(2)/324(4)/117(2)/303(2)/3(5) of BNS, 2023, on furnishing bail bond of Rs.25,000/- each with one suitable surety each of the like amount to the satisfaction of the arresting authority. 8. The direction for bail is further subject to the condition(s) that the petitioners: (a) that they shall cooperate with the investigation and appear before the I/O for examination; and (b) that they shall not hamper or tamper with the evidence. 9. Violation or breach of condition(s) shall entail cancellation of the bail. 10. List on 13.05.2026. JUDGE Comparing Assistant
