Mitra, the learned counsel appearing for the petitioner. Also heard Ms. M. Kumari, the learned Standing Counsel, CBI. 2. This is an application under Section 483 of the BNSS, 2023 whereby the Page No.# 2/2 petitioner Sanjay Roy has prayed for releasing him on bail after he was arrested in connection ACB Guwahati P.S. Case No.RC0172024E0008. 3. Today, Ms. M. Kumari has submitted that in the said case, the CBI has already filed the charge sheet. 4. Mr. Mitra submits that the CBI has filed an incomplete charge sheet and therefore, the petitioner is entitled to be released on bail. Mr. Mitra further submits that just to deprive the petitioner from getting default bail, this incomplete charge sheet has been filed. 5. I have considered the submissions made by the learned counsels of both sides. 6. Once, charge sheet has been filed, the trial court is the best forum where the petitioner should file the bail application. A charge sheet is a charge sheet. Law permits filing of supplementary charge sheet. 7. For the aforesaid reasons, the petitioner is advised to move the trial court for seeking bail.
