Affidavit of service filed by the petitioner is taken on record. None appears for the Panchayat despite service. Learned counsel for the petitioner submits that the private respondents have purchased a portion of the water body of which the petitioner is also a cosharer. The private respondents are raising construction by filling up the water body illegally. The petitioner submitted a representation before the Panchayat and the Block Land & Land Reforms Officer in this regard which have not been considered. Upon consideration of the submission made on behalf of the parties, this Court is of the view that since the representation submitted by the petitioner before the Pradhan, Jukhia Gram Panchayat has not been considered as yet, the said Pradhan being the respondent no.8 herein is directed to consider and dispose of the representation 2 dated 5th January, 2026 within two weeks from date upon granting reasonable opportunity of hearing to all concerned including the petitioner and the private respondents, in accordance with law. The decision taken by the authority shall be communicated to the parties within seven days thereafter. In the event unauthorised filling up of pond is detected by the authority necessary steps shall be taken in accordance with law. The writ petition is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted.
