.2026 Heard Mr. N. Borah, learned counsel for the petitioner. 2] The petitioner is aggrieved by the order dated 11.05.2026 passed by the First Appellate Authority namely the Director of Land Records & Surveys, Assam. The petitioner was appointed as Gaon Pradhan for Lot No.4 of Niz Sootea Salal Gaon under Naduar Revenue Circle, Mouza- Nagsankar of Biswanath District. In an appeal preferred by the respondent No.6 the First Appellate Authority interfered with the appointment of the writ petitioner and allowed the appeal by setting aside the order dated 01.12.2025 passed by the District Commissioner, Biswanath appointing the writ petitioner as Gaon Pradhan for Lot No.4 of Niz
Page No.# 3/4 Sootea Salal Gaon under Naduar Revenue Circle, Mouza- Nagsankar of Biswanath District. The District Commissioner of Biswanath was directed to take necessary steps in this regard. 3] Mr. J. Handique, learned Standing Counsel, Revenue Department submits that there is a provision for filing review against an order passed by the Appellate Authority under Regulation of 162(D). Under the provisions of Regulation 162(D) a review may be filed within a period of 90 days from the date of order of the Appellate Authority. 4] Having heard the learned counsel for the parties and considering the
submissions made, this Court permits the petitioner to take steps to file review before the concerned authority within a period of one week from today along with the certified copy of this order and upon the review being filed the same shall be disposed of within a period of 60 days from the date of filing the review. 5] Till the review is disposed of or till the expiry of 60 days from the date of filing of the review, the order dated 11.05.2026 interfering with the appointment of the writ petitioner passed by the First Appellate Authority as also the order passed by the District Commissioner dated 30.05.2026 shall remain stayed. 6] Needless to say that if the writ petitioner does not file the review within a period of 10 days as permitted by this Court then the interim order will automatically vacate without further reference from the Court.
