The petitioners are apprehending their arrest in connection with Barhi PS Case No.297 of 2025, for offence registered under sections 191(2), 191(3), 190, 126(2), 115(2), 117(2), 109(1), 351(2), 352 of the BNS, 2023, pending in court of learned S.D.J.M, Hazaribagh.

Learned counsel for petitioner submits that there are case and counter case between the parties and the altercation took place due to land dispute and it has come in the order of the learned Sessions Judge that the injury is simple in nature and the petitioner has got no criminal antecedent as disclosed in paragraph no.13 of the petition.
4. Learned State counsel opposes prayer and submits that allegation of assault is there and injury has also been received.

Considering that there are case and counter case between the parties and the altercation took place due to land dispute and it has come in the order of the learned Sessions Judge that the injury is simple in nature and the petitioner has got no criminal antecedent as disclosed in paragraph no.13 of the petition, I am inclined to grant anticipatory bail to petitioner.

Accordingly, petitioner, above named, is hereby directed to surrender before learned court within four weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned S.D.J.M, Hazaribagh, in connection with Barhi PS Case No.297 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS),
