Heard learned counsel for the Petitioners and learned counsel for the State. 3. The Petitioners apprehending their arrest in Singla P.S. Case No.45 of 2026 corresponding to C.T. Case No.165 of 2026, pending in the court of learned J.M.F.C., Basta for the alleged commission of offences punishable under Sections 109 (1)/115 (2)/126(2)/296/3(5)/324(4)/351 (2) /74/76 of BNS 2023, have filed this petition under Section 438 of the Cr.P.C. for release on pre- arrest bail. The brief fact of the case is that one Krishna Mallik wife of Debilal Mallik lodged a written report before the Singla P.S. alleging that on 30.01.2026 at 4 P.M. while a road construction work was going on as per the order of J.E., at that time, one Purna Chandra Mallik son of Prasant Mallik and 5 others of village Gotadiha P.S. wrongfully restrained and abused her in obscene languages and assaulted her, outraged her modesty by holding her hair and being half naked, damaged the falaka. When her husband tried to save her from the accused persons, they also assaulted him with a crowbar to commit murder and threatened to kill him in life. Hence, this case. 5. Learned counsel for the Petitioner submits that, as per the allegation the injured person named Debilal Mallik and the informant have been examined by the Medical Officer. The injuries are simple in nature. 6. Learned counsel for the State vehemently opposes the prayer for bail. 7. Taking into consideration the facts and submissions, factum of permanent residence of the Petitioners, it is directed that, the Petitioners shall be released on bail by the Arresting Officer, in the event of their arrest, in connection with the aforesaid case on such terms and conditions as deemed just and proper.
