Petitioner has filed this writ petition seeking following reliefs: "10.1 That, the Hon'ble Court may kindly be pleased to direct the respondent authorities to decide the pending representation of petitioner grant of benefit of pay scale of Rs.4750-7440 + Grade Pay Rs. 1,300/- from the date of initial appointment of petitioner, as granted to the other identically placed employee of District Raigarh (C.G.), within stipulated time. 10.2 That, any other relief/order which may deem fit and just in the facts and circumstances of the case including award of the costs of the petition may be given." 2. Learned counsel for the petitioner submits that the petitioner was initially appointed on collector rate, however, according to the circular issued by the State Government, the members belonging to the Primitive Tribes, such as Pahadi Korba and Birhor, are to be appointed as an exception to regular mode of appointment. The petitioner was entitled for regular pay-scale instead of collector rate on the post she was appointed. But, the said benefit has only been granted to her w.e.f. 20.02.2022. In this regard, petitioner has made representation to the respondent No.3 i.e. the Collector, Jashpur, however, no decision has been taken till date. Learned counsel also submits that for redressal of her grievance, petitioner may also be permitted to submit fresh representation before respondents No.3 and 4, who may be directed to be considered and decided the representation within a reasonable time. 3 / 3. Learned counsel appearing for the respondent- State opposes the submissions made by learned counsel for the petitioner and prays for dismissal of this petition. 4. On due consideration of the submissions of learned counsel for the parties, this writ petition, at this stage, is disposed of permitting the petitioner to file a fresh comprehensive representation for redressal of his grievance along with copy of this order and supportive documents before the concerned respondent No.3 and 4 and, in turn, the concerned respondents-authorities are directed to consider and decide petitioner's representation in accordance with law by passing a reasoned and speaking order preferably within a period of 3 months from the date of receipt of said representation. 5. With aforesaid observation, direction and without expressing any opinion on the merits of the case, the writ petition stands finally disposed of. No order as to cost.
