ORAL ORDER
1. Sri. Pawan Kumar, learned counsel accepts notice for respondent No.1 to 7.
2. Learned Additional Government Advocate accepts notice for respondent Nos.8 to 10.
3. Petitioner is before this Court seeking for the following reliefs: a. Issue a writ of Certiorari or any other the intimation 25/9/2025 issued by the 9th respondent at Vide any NO.- other KSRLPS appropriate IDDUGY- Sagoraenala writ gyash // Discontinution/202 Annexure-K;
b. Issue a writ of Mandamus or any other appropriate writ directing the respondents to consider the representation of the petitioner dated 6/8/2025 at ANNEXURE-A;
c. Issue a writ of Mandamus or any other appropriate writ directing the respondents to release the 1st installment of project cost in accordance with the Revised Sanction
order dated 9/6/2025 as per ANNEXURE-G;

d. Pass such other orders as this Hon'ble court deems fit in the facts and circumstances of the case, in the interest of justice and equity.
4. The grievance of the petitioner is that the earlier work
order, which had been issued to the petitioner for rendering training and other services, had been discontinued vide Annexure-K at 'page 64' of the petition. 5. The submission of the counsel for the petitioner is that the work order earlier having been issued, the work needs to be given to the petitioner. Annexure-K dated 25.09.2025 reads as under:

3. MoPSW Office Memorandum No. SM-25021/15/2015- SM(Sagaramala)-Part(1) (e 314305), dated:
05.08.2025. 4. Letter from MoRD, F. No.J-17060/59/2017DDU-GKY- Part(1) (357253), dated: 18.09.2025. With respect to the subject cited above, as per Ref. (1) and (2) the project has been sanctioned to M/s Abhaya Kalpa Technologies Pvt Ltd to impart the training and provide placement opportunities in the Coastal area districts in the State of Karnataka under the DDU-GKY Sagaramala convergence program. However, as per Office Memorandum dated 05.08.2025 by MoPSW (Ref. 3) and the letter from the MoRD dated 18.09.2025 the Sagaramala component under the DDU- GKY convergence program has been discontinued and it is informed that the PIA shall not initiate any new batches under the Sagaramala project from 1" October 2025. 6. A perusal of the said letter indicates that the Sagarmala convergence program with a component of DDU-GKY, under which the petitioner claims, has been discontinued. If that be so, when a project has been discontinued, the

question of the petitioner claiming that he still wants to continue with the project would not arise. 7.
The work order being essentially for one rendering services cannot be enforced even by way of a suit for specific performance. When the employer has discontinued a particular project, the contractor cannot insist that the project shall continue. There is no vested interest or vested right created in favour of petitioner, a mandamus cannot be issued directing the respondent to perform the obligation.
