For Petitioner : Mr.D.Krishnamoorthy For R1 to R3 : Mr.M.V.Ramachandra Murthy Public Prosecutor (Puducherry) Assisted by Mr.A.Alexander Government Advocate (Puducherry) O R D E R The present Writ Petition (Criminal) has been filed seeking a direction to the third respondent to provide adequate police protection to the petitioner firm namely M/s.Nethra Residency, situated at R.S.No.b103/7A, Pondy-Villupuram Main Road, Thirubuvanai, Puducherry, based on his representation dated 26.11.2025. 2. Learned counsel appearing for the petitioner submitted that the petitioner firm is a registered restobar functioning with a valid license and certificate received from the competent authority. However, the fourth respondent, motivated by business rivalry, has created a nuisance and caused trouble to the smooth functioning of the petitioner’s business. Thereby, unable to bear the illegal activities and harassment of the fourth respondent, a complaint was preferred before respondents 1 to 3. Learned Public Prosecutor (Puducherry) appearing for respondents 1 to 3 submitted that the third respondent is the competent authority to consider the representation of the petitioner and that he will consider the same and pass orders within a specified time. 4. Heard both sides and perused the materials available on record. 5. In view of the above, the third respondent is directed to issue appropriate notice to the petitioner as well as to the fourth respondent under Section 35(3) of BNSS, conduct an enquiry in the manner known to law and dispose of the petitioner’s representation within a period of four weeks from the date of receipt of a copy of this order. It is made clear that the petitioner shall not be harassed during the course of the enquiry. 6. Accordingly, this Writ Petition (Criminal) stands disposed of.
