1. The instant interlocutory application has been filed on behalf of opposite parties for withdrawal of the show-cause filed on 19.11.2025 which contains a report of Circle Officer, Gawan, Giridih.
2. It has been contended in the interlocutory application that the Circle Officer, Gawan, Giridih has submitted a report said to be correct which was found incorrect after an inquiry has been conducted under the direction of the Deputy Commissioner, Giridih, O.P. No.2 and, therefore, the present interlocutory application has been filed for withdrawal of the earlier show cause along with inquiry report.
3. It has further been stated in the instant IA that for the fault committed by the concerned Circle Officer, a show-cause has been issued and a decision has been taken to initiate departmental proceeding by the controlling department and also memorandum of charge has been issued against him.
4. It has been submitted that a fresh inquiry report will be brought on record by way of filing subsequent show-cause on behalf of O.P. Nos. 2 and 3.

5. This Court considering the reasons assigned in the present interlocutory application is granting leave to withdraw the earlier show cause dated 19.11.2025 along with inquiry report.
6. Accordingly, the instant interlocutory application stands allowed and

The learned counsel appearing for the opposite party nos. 2 and 3 has submitted by referring to the fresh inquiry report annexed as annexure-D to the show cause filed on behalf of OP no.2 wherein the facts have been brought on record by way of tabular chart showing the names of the encroachers/the occupants of the premises in question. It has been stated that eight persons whose names have been figured at Sl. Nos. 7,8,9,10,11,12,13 and 14, namely, Lakhan Ram, Chotu Mian, Ram Chandra Ram, Anurupa Devi, Brahmdev Ram, Jagdish Ram, Chandmal Ram and Chinta Devi respectively have moved this court by filing writ petition being WP ( C) 347 of 2026, WP ( C) No. 409 of 2026 and WP (C) No. 121 of 2026 in which the court has passed interim protection not to disturb them from their possession over the land in question. It has further been contended that so far as the land said to be encroached by Dinesh Ram, Jivlal Yadav, Arti Devi, Brajesh Kumar and Ramchandra Prasad Yadav are concerned, the land has been made encroachment free. 8. Further the allegation of encroachment by Lakhan Mistri and Bindeshwar Singh, no encroachment has been found over the land in question. So far as the land said to be encroached by Baijnath Ram is concerned, the land has partially been made encroachment free but by virtue of the order passed by this court in WP(C) No. 121 of 2026, further demolition has been stayed. 9.

The learned counsel for has submitted that so far as the land which is still found encroached as per inquiry report by the person(s) who has/have moved to this court by filing writ petition(s) the steps will be taken depending upon outcome of the said writ petition(s) without any further delay. 2026:JHHC:4906

So far as inquiry which has been initiated against the concerned Circle Officer is concerned, since the charge memo has been issued and, as such, the same should be given conclusive end in accordance with law. 12. Therefore, the Principal Secretary, Personal Administrative Reforms and Rajbhasa Department, Government of Jharkhand, is directed to expedite the proceeding so that the same be concluded as per the applicable Classification, Control and Appeal Rules. 13.
Considering the reference of the factual aspects as made herein above, the instant contempt case is disposed of. 14. The pending interlocutory application(s), if any, stands disposed of. 15.
