Mr. Bhuvnesh Joshi, learned Amicus Curiae for the Appellant.
2. Mr. Girish Chandra Joshi, learned AGA for the State.
3. As per observation detailed in the last order sheet dated 03.12.2025 whereby the Coordinate Bench had noted after the current situation being brought to the notice of the Court by the learned Amicus Curiae, who is present today.
4. As per order of the Coordinate Bench dated 03.12.2025, the Coordinate Bench had observed as follows:-
“3. Pursuant to the previous
order dated 17.11.2015, learned State Counsel has supplied the instructions to the Court. The said instructions are taken on record.
4. Learned AGA on the basis of those instructions submits that the appellant-Hemant Singh Karayat has been granted clemency by the Governor of the State under Article 161 of the Constitution of India and accordingly, he has been released from jail on 15.08.2023.
5. In such view of the matter, issue administrative notice to the appellant enabling him to choose whether he intends to challenge the conviction recorded by the learned trial court or not?
5. Today again the appellant is before this Court, who has already been released on 15.08.2023 as per order of Governor of State of Uttarakhand granting him clemency.
6. In view of this Court it is unnecessary for summoning a person back to the Court of trial from where he was released as per the appeal before the Governor of the State. Moreover, issuing notice and summoning him to face the legal consequences
whatever with or without his wish may be unjustified.
7. Considering the same, this Court is of the view that since on his plea he has been released on 15.08.2023 about three years back it would be unjust to ask him to go before the court once again. Thus, nothing remains in the matter. The file be consigned to the record room.
