JUSTICE SANDEEP KUMAR ORAL ORDER 2 02-04-2026 Heard learned counsel for the petitioners and learned APP for the State. 2. The petitioners seek bail in connection with Balrampur P.S. Case No. 207 of 2025 registered for the offence punishable under Sections 191(2), 190, 126(2), 115(2), 118(1), 109(1), 74, 303(2), 351(2) and 351(3) of the Bharatiya Nyaya Sanhita. 3. The petitioners are accused of assaulting the victim causing grievous injury. 4. There is no specific allegation against petitioner nos. 1, 3 and 4. However, there is specific allegation against petitioner no. 2. Patna High Court CR. MISC. No.21116 of 2026(2) dt.02-04-2026 2/2 5. Learned counsel for the petitioners submits that the scuffle took place due to a trivial dispute and the medical report shows that there was no repeated blow. 6. The petitioner no. 1 is in custody since 20.12.2025 and petitioner nos. 2, 3 and 4 are in custody since 24.12.2025. 7. Considering the submission of learned counsel for the petitioner, the period of custody of the petitioners and also the fact that it was not a case of repeated blow, this application is allowed. 8. Let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st, Katihar/ concerned Court in connection with Balrampur P.S. Case No. 207 of 2025. 9. It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioners at any subsequent stage of the trial and this Court has not express any opinion on the merits of the case.
