The petitioner is apprehending his arrest in connection with Complaint Case No. 3887 of 2024, registered for the offence under Section 47(a) of the Excise Act, pending in the court of learned Judicial Magistrate, 1st Class, Jamshedpur. 3. Learned counsel appearing for the petitioner submits that from a house near the mountain besides the river, 2600 Kgs. Jawa Mahua has been recovered. He next submits that on the basis of suspicion, the name of the petitioner has come and who has taken the name of this petitioner is not disclosed in the complaint. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that the petitioner is having the criminal antecedents. 5. Looking into the contents of the FIR, it transpires that the jawa mahua has been recovered from a house near the mountain besides a river and the name of the petitioner has come on the basis of suspicion and on whose disclosure the name of the petitioner has come, is not disclosed in the complaint. In that view of the matter, the [ 2026:JHHC:1382] -2- petitioner, named above, is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
