JUSTICE ASHOK S.KINAGI ORAL ORDER The petitioners filed this petition seeking a mandamus directing the respondent-University to approve the admissions of petitioner Nos.2 to 5, who are admitted to 1st year Bsc (Nursing) for the academic year 2024-25. 2. Brief facts, leading rise to the filing of this writ petition are as follows: The respondent University has issued a notification dated 15.03.2025 granted approval/affiliation to the petitioner-Institution to start Bachelor of Science (Nursing) for the academic year 2024-25 with an intake of 40 seats. Petitioner No.1 admitted the students for the academic year 2024-25 and the last date for submitting the list of the candidates admitted by the petitioner society was on 30.12.2024. It was extended by issuing a circular date 24.12.2024 upto 04.01.2025. Petitioner No.1 did not send the names of petitioner Nos.2 to 5 for approval within the - 4 - HC-KAR NC: 2026:KHC:10007 WP No. 38282 of 2025 time stipulated by the respondent University. Petitioner No.1 sent a letter to the University regarding the admission for approval of petitioner Nos.2 to 5 for the academic year 2024-25 on 16.06.2025. The University refused to approve the admissions of petitioner Nos.2 to 5 on the ground that the said application was received after the stipulated time. Hence, this writ petition. 3. The respondent-University filed a statement of objections contending that, initially, the petitioner has not sent the list containing the names of petitioner Nos.2 to 5 within the stipulated time. Hence, the University has rightly declined to approve the admissions of petitioner Nos.2 to 5 on the ground that the list was not furnished within time. Hence, prays to dismiss the writ petition. 4. Heard the arguments of the learned counsel for the petitioners, and also the learned counsel for the respondent-University. - 5 - HC-KAR NC: 2026:KHC:10007 WP No. 38282 of 2025 5. Learned counsel for the petitioners submits that the petitioners were admitted within the time stipulated by the University, but was unable to forward the documents/details within time. Thus, there was a delay in submitting the documents to the respondent-University. He submits that, by virtue of an interim order, the petitioners have completed 1st year, and they have appeared for the examination pursuant to the interim order. He submits that the cost may be imposed on petitioner No.1 and direction be issued to the respondent- University to approve the admissions of petitioner Nos.2 to 5. Hence, on these grounds, he prays to allow the writ petition. 6. Per contra, learned counsel for the respondent- University submits that petitioner No.1 did not furnish the list of candidates i.e., petitioner Nos.2 to 5 within time. The respondent-University has rightly declined to approve the admissions of petitioner Nos.2 to 5. He submits that if - 6 - HC-KAR NC: 2026:KHC:10007 WP No. 38282 of 2025 the Court comes to a conclusion that the admission of petitioner Nos.2 to 5 are required to be approved. This order should not be a condition precedent for others and he also submits that heavy cost may be imposed on petitioner No.1-Institution and accordingly,prays to dispose off the writ petition. 7. Perused the records, and considered the submissions of the learned counsel for the parties. 8. It is an undisputed fact that petitioner No.1 admitted petitioner Nos.2 to 5 for 1st year BSc Nursing course for the academic year 2024-25. Petitioner No.1 did not forwarded the list of the candidates i.e., petitioner Nos.2 to 5 within the times stipulated by the University i.e., on 30.12.2025, and subsequently, the respondent- University has issued a circular extending the time for submitting the documents upto 04.01.2025. Even after extension, petitioner No.1 did not forwarded the names of petitioner Nos.2 to 5. The respondent-University declined - 7 - HC-KAR NC: 2026:KHC:10007 WP No. 38282 of 2025 to approve the admissions of petitioner Nos.2 to 5 only on the ground that they have not sent the list of the names of the petitioner Nos.2 to 5 within the time. It is not the case of the respondent-University that petitioner Nos.2 to 5 are not eligible for the course of Bsc (Nursing) course. By virtue of an interim order, petitioner Nos.2 to 5 have already completed 1st Bsc (Nursing). Therefore, it would be appropriate if petitioner No.1 is directed to pay the penalty of Rs.4,00,000/- to the respondent-University, otherwise the career of petitioner Nos.2 to 5 will be effected. 9. In view of the above discussion, I proceed to pass the following: ORDER i. The writ petition is allowed. ii. The respondent-University is directed to approve the names of petitioner Nos.2 to 5 for Bsc (Nursing) course subject to petitioner No.1 depositing the penalty of Rs.4,00,000/- - 8 - HC-KAR NC: 2026:KHC:10007 WP No. 38282 of 2025 to the respondent-University within 15 days from the date of receipt of certified copy of this order. iii.
