1. Heard learned Counsel Mr.P.D. Choudhury for the petitioner Ikbal Sheikh who has filed this application under Section 482 of the BNSS, 2023 with prayer for transit bail to enable him to appear before the Officer-In-Charge of Cyber
Page No.# 2/3 Cell Police Station Bakhira, Sant Kabir Nagar, Uttar Pradesh as he has been booked in a case of cyber fraud in connection with complaint No.
33105260114614.
2. It is submitted that a notice has been issued to the petitioner to appear before the Cyber Cell Police Station Bakhira, Sant Kabir Nagar, Uttar Pradesh within seven days of receipt of the notice. Annexure-1 is the notice issued against the petitioner Ikbal Sheikh. The notice reflects fraud balance of Rs. 47,000/-against the petitioner.
3. Learned Addl.Public Prosecutor Mr.K.K. Parashar is present for the State respondent
4. I have considered the submissions at the bar with circumspection.
5. The petitioner has received notice under Section 35(3) of the BNSS. As he has received the notice, he is willing to appear before the concerned Arresting Authority and co-operate with the investigation.
6. After considering the submission that the petitioner is willing to co-operate with the investigation, it appears that he may be granted transit bail.
7. Thereby, the petitioner is directed to appear before the concerned Investigating Officer within 30 (thirty) days on or before 21.07.2026 and co- operate with the investigation.
8. Considering the entire aspect of the matter, it is directed that in the event of the arrest of the petitioner in connection with the aforesaid case, he shall be released on transit bail on executing a personal bond of Rs.50,000/- with two
Page No.# 3/3 sureties of the like amount to the satisfaction of the arresting authority upto
21.07.2026.
9. It is made clear that the present interim protection in the form of transit bail has been granted to the petitioner only in order to enable him to approach the Court of competent jurisdiction for anticipatory bail on merits.
10. In terms of the above observation, this anticipatory bail application is
disposed of .
