Parashar, learned Additional Public Prosecutor for the State. 2. This application has been filed under Section 483 of the Bharatiya Nagarik Suraskha Sanhita, 2023, whereby the petitioner Gappur Ali has prayed for bail Page No.# 2/3 as he is behind bars since 09.06.2026 in connection with Sapatgram P.S Case No. 54/2026 registered under Sections 61(2)/303(2)/317(2)/317(4) of BNS r/w Section 13(10 of Assam Cattle Preservation Act, 2021 and Sections 11(1) (a)/11(1)(d)/11(1)(e) of the Prevention of Cruelty to Animal Act, 1960. 3. Learned Additional Public Prosecutor has raised serious objection stating that the petitioner is the mastermind of this case and he is not entitled to bail. Investigation has just commenced and releasing him on bail may adversely affect the investigation. 4. Per contra, the learned counsel for the petitioner has submitted that the co- accused have already been enlarged on bail. All the cattle smuggled through the Bolero vehicle bearing registration No. AS-01-HC-0989 has been recovered. Therefore, custodial detention may not be required for the progress of investigation. 5. After considering the submissions at the Bar, it appears that bail may be granted to the petitioner. 6. The petitioner is enlarged on bail of Rs.30,000/- (Rupees Thirty Thousand only) with a suitable surety of like amount subject to the satisfaction of the learned Jurisdictional Court/Elaka Magistrate with following conditions: (i) the petitioner shall refrain from such activities with which he is alleged; (ii) (ii) the petitioner shall appear before the I.O. on every fortnight till completion of the investigation; and (iii) (iii) the petitioner shall not try to influence the witnesses or tamper with the Page No.# 3/3 evidence. 7. On breach of any of the bail conditions, the court is at liberty to immediately cancel the bail granted to the petitioner. 8. Accordingly, the bail application stands disposed of.
