2 / 3 ‘a. This Hon’ble Court may kindly be pleased to issue a writ in the nature of mandamus or suitable direction/directions/order/orders
directing
the respondent authorities to release gratuity and other retiral dues of the service of the petitioner including the allowances and leave encashment. b. May kindly be pleased to allow any other relief as the Hon’ble Corut may be deemed fit and proper with the cost of petition.”

Learned Counsel for the petitioner submits that petitioner while working on the post of Production Assistant retired from service after attaining the age of superannuation on 30.06.2024. Since the date of retirement for more than about one and a half year petitioner has not been paid retiral dues. Petitioner is facing great financial hardship to make out the expenses which he has to incur in his old age, and therefore, direction be issued to respondent no. 1 and 2 to consider and take decision on the claim of petitioner and released the retiral dues.

Learned counsel for respondent submits that in view of limited prayer made by learned counsel for the petitioner he is having no objection and the claim of petitioner will be considered in accordance with law.
4. On due consideration of submission made by learned counsel for the respective parties and particularly considering the submission made by
learned counsel for petitioner that after retirement of petitioner i.e. since June, 2024 he has not been paid any retiral dues, I find it appropriate to dispose of this writ petition at this stage, directing respondent no. 1 and 2 to consider the claim of petitioner in an
3 / 3 objective manner and to release the undisputed gratuity amount at the earliest. Let the decision be taken up within a further period of 45 days from the date of receipt of the order.
5. With the aforesaid observation and direction, this writ petition stands
