Heard Mr. N Uddin, learned counsel appearing for the petitioners. Also heard Mr. B. Sharma, learned Additional Public Prosecutor, Assam. By this application filed under Section 483 of the BNSS, 2023, the petitioners, namely, (1) Anisur Rahman and (2) Ayub Ali Sk @ Ayub Ali Sheikh have prayed for release on bail in connection with Basugaon P.S. Case No. 06/2026. The petitioner no. 1 Anisur Rahman has completed 61 (sixty one) days in judicial custody though charge sheet has been filed. Therefore, he is entitled to default bail. Accordingly, the petitioner no. 1 Anisur Rahman, who is in custody in connection with Basugaon P.S. Case No. 06/2026, is allowed to go on bail of Rs.25,000/- with one surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Chirang. In so far as the petitioner no. 2 Ayub Ali Sk @ Ayub Ali Sheikh, he has already completed 58 (fifty eight) days in judicial custody. Considering the period of detention already undergone by the petitioner no. 2 above, who is also in custody in connection with Basugaon P.S. Case No. 06/2026, is allowed to go on bail of Rs.25,000/- with one surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Chirang. The bail application is disposed of.
