THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR. JUSTICE R DEVDAS ORAL ORDER Learned Additional Government Advocate takes notice for respondent Nos.1 to 5. Notice to respondent No.6 is not necessary for the following reasons.
2. The petitioner is aggrieved of the impugned endorsement at Annexure-Q issued by the Assistant Commissioner, Chikkaballapur Sub-Division, declining to entertain an appeal filed by the petitioner.
3. It is the contention of the petitioner that by virtue of orders passed by the learned Principal Civil Judge and JMFC, Gowribidanur in O.S.No.293/2009, filed by the petitioner herein, an entry is made in column number 11 regarding the interim orders dated 23.06.2023 passed by the Court in O.S.No.293/2009, that there shall not be any encumbrance or transaction during the pendency of the suit. An entry has been made by the Tahsildar at the instance of the private respondent

judgment and decree passed in O.S.No.202/2021, which has already been questioned by the petitioner in O.S.No.70/2024.
4. Having heard the learned counsel for petitioner, the learned AGA and on perusing the petition papers, this Court is of the considered opinion that no infirmity can be found in the impugned endorsement issued by the Assistant Commissioner. The revenue authorities will be bound by any order or
Judgment or decree passed by a competent Civil Court. That being the position, if an entry has been made by the Tahsildar pursuant to the judgment and decree passed by a competent Civil Court in O.S.No.202/2021, the same cannot be questioned before the Assistant Commissioner. The avenue open for the petitioner is to either seek stay of the judgment and decree passed in O.S.No.202/2021 or get the same set aside in a manner known to law.
5. Even otherwise since an entry has been made in column number 11 that there shall not be any further alienation or transfer during the pendency of the suit in O.S.No.293/2009, that should protect the interest of the petitioner. Liberty is
