HOUSEWIFE, RFO D.NO.23-3-615, 11TH STREET, PODALAKUR ROAD, NELLORE CITY, NELLORE, SPSR NELLORE DISTRICT.C ...RESPONDENT(S): Counsel for the Petitioner(S): VALLURU CHETAN SUSHEEL Counsel for the Respondent(S): 3 Dr. YLR, J W.P.No.9990 of 2026 Dated 16.04.2026 GP FOR HOME The Court made the following: ORDER: The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:- “…to issue an appropriate writ order or direction more particularly one in the nature of a Writ of Mandamus declaring the action of the respondent police in calling the petitioners to the police stations namely Dargamitta Police Station and CCS Police Station Nellore without any crime registered against them and in threatening them with dire consequences in the event of their failure to produce the missing persons as illegal arbitraiy and violative of Articles 14 19 and 21 of the Constitution of India and consequently direct the respondent police not to summon the petitioners to the said police stations except in accordance with law and to pass….” 2. Heard the learned counsel for the petitioners and the learned Assistant Government Pleader. 3. Mr. V. Chetan Susheel, learned counsel for the petitioners, submits that, without there being any case registered against the petitioners, the respondent police are unnecessarily calling the petitioners to the police station and subjecting them to harassment. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that respondent No.9 has submitted a complaint, based on which a case in Crime No.143 of 2026 under the head “Woman Missing” was registered at Dargamitta Police Station on 06.08.2025 by respondent No.4, and investigation was taken up. The petitioners were called to the police station just for the purpose of investigation. The 4 Dr. YLR, J W.P.No.9990 of 2026 Dated 16.04.2026 petitioners were neither arraigned as accused nor shown as suspects in the FIR lodged by respondent No.9. 5. Considering the entire facts and circumstances of the case, and recording the submissions of the learned Assistant Government Pleader and the learned counsel for the petitioners, the Writ Petition is disposed of, directing the respondent police not to call henceforth the petitioners to the police station without any basis and not to interfere with their liberty. Further, it is made clear that, in the investigation, if it is revealed that the petitioners have also played any role in the commission of the offence, the Investigating Officer is at liberty to proceed in accordance with law. 6. With the above observations and directions, the Writ Petition is disposed of. There shall be no order as to costs.
