Learned counsel for the petitioner submits that partition suit, which the State Authority has relied upon while dropping the Permission Case, already stood dismissed, prior in time. Considering the fact that liberty has already been given in the impugned order to the petitioner to approach after disposal of the partition suit and since the partition suit has already been dismissed, may be for non- prosecution, the petitioner should approach the Additional Collector, Hazaribagh by invoking Section 46 of the Chhotanagpur Tenancy Act, 1908 again by filing appropriate application.
