This Writ Petition has been filed against the order dated 17.07.2020 (Annexure P/1) passed by Additional Collector, Raigarh C.G. in Revision case No.57/A-27/2019-20 arising out of proceedings dated 05.10.2019 (Annexure P/2) and Annexure P/3 drawn by the Court of Tehsildar Pusour in Revenue Case No.28/A-27/2000-01, whereby Tehsildar Pusour has drawn the proceedings (Annexure P/2 and P/3) by exceeding jurisdiction upon the application moved by private respondents for the relief of partition. 2. Petitioners by way of this writ petition has prayed for the following reliefs:- 4 10.1 That, this Hon'ble Court may kindly be pleased to issue a Suitable Writ (s), Order (s), Direction (S), by quashing the order dated 17-07-2020 (Annexure P/1), arising out of proceeding (Annexure P/2 & P-3) passed in Revenue Case No. 28/A-27/2000-01, and to issue a suitable writ in the nature of prohibition for preventing an order or decision being made which if made would be subject to certiorari. 10.2 That, this Hon'ble Court may kindly be pleased to call the entire records from the court below for its kind perusal. 10.3 Any other relief, which may be suitable in the facts and circumstances of the case, may also be granted. 3. Brief facts of the case are that Respondents no. 2 to 14 have filed an application U/s. 178 of Chhattisgarh Land Revenue Code 1959 for partition of suit land. On 05-10-2019, the Court of Learned Tehsildar Pusour has passed an interim order dated 05-10-2019 in Revenue Case No. 28/A- 27/2000-01. Against the order dated 05-10-2019 (Annexure P-2) the petitioners have filed a revision U/s. 50 of the Chhattisgarh Land Revenue Code 1959 before the Court of Learned Collector Raigarh. On 17-07-2020, the Court of Learned Additional Collector Raigarh has passed an impugned order by directing Court of Learned Tehsildar Pusour to pass an order. Whereas, the entire proceedings as initiated by the respondents no. 15 & 16, is/are illegal and without jurisdiction and the order and the entire proceeding passed by the respondents no. 15 & 16, is void- ab-initio. Hence this petition. 5 4. Learned counsel for the petitioner submits that against the interim order dated 05.10.2019 (Annexure P/2) this petition has been filed, however, he is not having information regarding the main case which has been filed before the Tehsildar Pusour. As such, learned counsel seeks permission of this Court to withdraw this petition so that he may pursue the matter which is lying pending before the concerned Tehsildar. However, he submits that the concerned Tehsildar may be directed to expedite the proceedings before him and conclude the same in a time bound manner. 5. Since learned counsel for the petitioner wishes to pursue the matter before the Tehsildar, this Writ Petition is disposed of as withdrawn. 6. However, if the proceedings before the Tehsildar, Pusour has not yet been culminated, the same shall be concluded by him in an expedite manner within a period of 45 days from the date of receipt of copy of this order.
