Learned advocate appearing for the petitioner at the instruction submits that anticipatory bail of the petitioner was rejected by the Hon’ble Apex Court and was granted two weeks time to surrender before the jurisdictional Court in Special Leave to Appeal (Crl.) 15863/2025. Learned advocate for the State opposes the prayer for bail. I have taken into account the quantum of seizure which is 47 bottles of phensedyl and that charge-sheet has already been submitted before the jurisdictional Court. Petitioner has also submitted himself to the jurisdiction of the Court for facing trial, consequently, I am of the view further detention of the petitioner after 35 days is unwarranted. As such, the prayer for bail of the petitioner is allowed.
2 Accordingly, petitioner namely, Multan Sk shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the I of the learned Additional District Judge, 3rd Court cum Special Court, Malda. If on bail, the petitioner shall be physically present on each and every date fixed before the learned trial Court in seisin of the case and shall not leave the jurisdiction of district of Malda without the prior permission of the learned Special Court. Thus, the prayer for bail in CRM (NDPS) 380 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
