1. Heard Mr. B. Choudhury, learned counsel for the petitioner. Also heard Mr. D. P. Goswami, learned Additional Public Prosecutor for the State of Assam.
2. This is an application filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in respect of PRC No.29/2026 (G.R. No.907/2025), pending in
Page No.# 2/3 the Court of the learned Additional Chief Judicial Magistrate, Lakhimpur, North Lakhimpur.
3. The petitioner, Md. Abdul Rezzak @ Abdul Rejjak has been shown as an absconder in the Charge-Sheet for commission of sessions triable offences. The Court of the learned Additional Chief Judicial Magistrate, Lakhimpur, North Lakhimpur has
directed issue of summons to the petitioner. The petitioner submits that since this Court does not have the jurisdiction to entertain his bail application, he may be remanded to custody.
4. The petitioner now submits that he is interested in facing the trial and, therefore, he should be given adequate opportunity to that effect.
5. I have considered the submissions made by the learned counsel of both sides.
6. This Court is of the opinion that since the petitioner is interested in facing the trial he deserves to be given an adequate opportunity to that effect. Therefore, his application is allowed.
7. The petitioner, Md. Abdul Rezzak @ Abdul Rejjak is directed to appear before the Court of the learned Additional Chief Judicial Magistrate, Lakhimpur, North Lakhimpur in connection with the PRC No.29/2026 (G.R. No.907/2025) within a period of 15 (fifteen) days from today and on his appearance he shall be allowed to go on bail of Rs.25,000/- with a surety of like amount to the satisfaction of the learned Additional Chief Judicial Magistrate, Lakhimpur, North Lakhimpur.
8. The petitioner, Md. Abdul Rezzak @ Abdul Rejjak is directed to appear before the Trial Court on each and every date of hearing. If he fails to do so, the Trial Court
Page No.# 3/3 shall have the liberty to procure his attendance by due process of law.
