02/ 21.01.2026: Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with Balumath P.S. Case No. 119 of 2025, registered under sections 17(b), 22(b) and 29 of NDPS Act, pending in the Court of learned Special Judge, NDPS, Latehar.

Learned counsel for the petitioner submits that the name of the petitioner has come on the confessional statement and 1.066 kg of opium was recovered from the possession of co-accused Rajesh Kumar Saw and Jitendra Saw and quantity is intermediary. He further submits that although the petitioner has one criminal antecedent but the same is not similar in nature.

Learned counsel for the State opposes the prayer and submits that the name of the petitioner has come on the confessional statement of the co-accused and the petitioner is supplier of the said article.

Considering that the name of the petitioner has come in the confessional statement of the co-accused and the said opium has been recovered from the possession of the co-accused and the quantity is intermediary and further the petitioner has one criminal antecedent which is not similar in nature, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the above named, petitioner is directed to surrender before the learned court within four weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Special Judge, NDPS, Latehar in connection with Balumath P.S. Case No. 119 of 2025, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
