Petitioner has filed this petition seeking following relief (s) :- “10.1 That, this Hon’ble Court may kindly be pleased to call for the entire records in relates to the case of the petitioner from the possession of respondents for its kind perusal. 10.2 That, this Hon’ble court may kindly be pleased to set aside/quash the posting dated 05/06/2025(Annexure P/2) issued after the counseling by respondent no. 5 whereby petitioner has been posted Government Primary School, Kurra, Block – Dharsiva, District – Raipur from his present place of working Government Primary School, Banrasi, Block – Dharsiva, District – Raipur. 10.3 That, this Hon’ble Court may kindly be pleased to direct the respondent no. 2 who is head of Director Level Rationalization Committee to decide the appeal application of the petitioner pending before it whereby he has challenged the order dated 15.09.2025 passed by the three member committee headed by the Commissioner. 10.4 That, this Hon’ble Court may kindly be pleased to grant any other relief/relief’s in favor of the petitioners, which the Hon’ble Court deemed fit & just in the facts 3 and circumstances of the case, including awarding of the costs of the petitioner.” 2. Learned counsel for petitioner submits that petitioner while posted at Govt. Primary Shcool. Kurra, Block- Dharsiva, District – Raipur under the Rationalization Policy treating him to be surplus, against the order of transfer and posting under Rationalization Policy petitioner has initially submitted a representation as provided under the Rationalization Policy before District Level Committee which came to be dismissed against which petitioner submitted representation before Divisional Level Committee which too came to be dismissed. Petitioner thereafter, availed other remedy available to him under the Rationalization policy of submitting a representation before State Level Committee headed by Directorate of Public Instructions vide Annexure P-6 dated 10.10.2025 which till date is pending consideration and, therefore direction be issued to concerned authority i.e. respondent no. 2 to consider and take decision on the pending representation at the earliest, within specified time frame. 3. Learned State counsel submits that in view of limited prayer made by learned counsel for the petitioner, she is having no objection. 4. It is not in dispute that under the Rationalization Policy three committees have been constituted that is the District Level Committee, Divisional Level Committee and State Level Committee. From the documents it is apparent that petitioner has submitted a representation before the State Level Committee which is headed by Directorate of Public Instructions. 5. In view of the aforementioned facts of the case, this writ petition at this stage, is disposed of directing respondent no. 2 to consider and decide 4 the representation submitted by petitioner raising grievances as raised in this writ petition under the Rationalization Policy, in accordance with law, expeditiously, preferably within a further period of 06 weeks from the date of receipt of the Order. 6.
