The instant misc. petition has been filed by the petitioner with the following prayer: “It is therefore, prayed that this Criminal Misc. Petition may kindly be accepted and allowed and the direction may kindly be issued to conduct the investigation of the Inquiry No.13018/2020 speedily and fairly and impartially and since Inquiry is pending for Four years therefore direction may kindly be issued to change the Investigation Officer and submit the report forthwith in the court below conducting fair and impartial investigation. Any other order or direction which this Hon'ble Court may deem fit and proper be also passed in favor of humble petition in the interest of justice.” 2. By way of filing the instant petition, direction has been sought to b issued to the Investigating Agency for conducting speedy investigation in a fair and impartial way with regard to the Inquiry of Complaint No. 13018/2020 pending before the Court of Additional Chief Judicial Magistrate No.3, Kota. 3. Learned counsel for the petitioners submits that the aforesaid complaint was filed by the petitioners against the accused-respondents before the Additional Chief Judicial Magistrate No.3, Kota wherein the matter was sent to the [2026:RJ-JP:22355] (3 of 4) [CRLMP-8092/2024] concerned Police Station for conducting inquiry in the same. The aforesaid directions were issued by the learned Magistrate on 15.12.2020 and in spite of passing of more than five years, till date, inquiry has not been concluded by the concerned officer. Under such compelling circumstances, the petitioners have approached this Court with the aforesaid prayer. 4. This Court, on the last occasion, directed the Registrar (Judicial) of this Court to get the status of inquiry from the Court below, pursuant to the aforesaid directions. The ACJM No. 3, Kota, vide letter dated 18.05.2026, has informed this Court that till date, the inquiry is pending at the instance of the concerned Circle Officer. 5. This Court is not satisfied with the actions of the concerned Investigating Officer in not submitting the progress report/conclusion report of the inquiry before the concerned Court, despite passing of more than 5 years. 6. This Court deems it just and proper to dispose of the instant petition with directions to ACJM No. 3, Kota to direct the Investigating Officer to submit the conclusion report of the aforesaid inquiry expeditiously, as early as possible, before the concerned Court. In case, the inquiry report is not submitted by the Investigating Officer in a timely manner, appropriate orders shall be passed by the Court below with regards to the conduct of the Investigating Officer.
