Case No.643 of 2025 dated 03.10.2025 under Sections 126(2), 115(2), 118(2), 109(1), 3(5) of the BNS. And In the matter of: Sukbas Sk. @ Sukhbas Sk. ….Petitioner. Mr. Anit Dey Mr. Ankan Santra ….for the petitioner Mr. Debabrata Chatterjee Ms. Sonali Bhar ….for the State Learned counsel appearing on behalf of the petitioner submits as follows. There was a dispute between the petitioner’s brother and the de facto complainant. The principal accused was arrested and was thereafter granted bail. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. She refers to the injury report, which shows deep cut injury on right shoulder inflicted with a sharp cutting weapon, which had to be referred to a plastic surgeon. As per the witnesses statements both the brothers including the present petitioner assaulted the victim with a ‘hasua’. This resulted in severe cut injury on the hand of the victim. The cut portion was practically about to get severed and to have fallen off. Considering the above, the other incriminating materials available in the case diary and the alleged role ascribed to the present petitioner, I do not consider this to be a fit case for granting anticipatory bail. 2 The application for anticipatory bail is, thus, rejected. Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities. (Jay Sengupta, J.)
