The instant bail application has been filed under Section 483 BNSS on behalf of accused-applicant against the order dated 12.03.2026 passed by learned Additional Sessions Judge No.7, Jaipur Metropolitan-II in connection with FIR No. 155/2025 registered at Police Station Jhotwara District Jaipur (West) for the offences under Sections 115(2), 126(2), 3(5) & 74 of BNS, by which the bail application of the accused-applicant under Section 483 of BNSS was dismissed.
2.
Learned counsel for the accused-applicant submits that the accused-applicant has falsely been implicated in this case. He further submits that incident occurred on 08.03.2025 and on that day, the police recorded Parcha Bayan of the injured Shankar
[2026:RJ-JP:22992] (2 of 3) [CRLMB-4711/2026] Choudhary in Trauma Centre of SMS Hospital, Jaipur and in that Parcha Bayan he did not named the accused-applicant. It is further submitted that the FIR was registered on 09.03.2025 on the report of father of the injured; that as per the injury report, the grievous injury caused to the injured has not been found dangerous to life and the same has not been attributed to the present accused-applicant; that the charge sheet of other accused persons namely Ambrish Kumar Soni & Shyam Pratap Singh has been filed and they have already been enlarged on bail by this Court vide order dated 16.05.2025 passed in S.B. Criminal Miscellaneous Bail Application No.4883/2025 and the case of the present accused-applicant is not different from the case of that of co-accused persons. Learned counsel further submits that the accused-applicant was arrested on 25.02.2026, and since then he is behind the bars and trial will take considerable time to conclude. Therefore, the accused-applicant may be enlarged on bail. 3. Learned Additional Govt. Advocate as well as learned counsel for the complainant vehemently oppose the bail application and submit that in this case injured Shankar Choudhary had sustained several injuries and out of which fracture was found in right tibia, right ring finger and in skull; that the accused-applicant is absconded from the date of the incident, therefore, he could not arrested on time; that the accused-applicant has criminal antecedents, therefore, it is prayed that the bail application of accused-applicant should be dismissed. 4. Heard and perused the material available on record. 5. Considering the facts that in Parcha Bayan, injured did not attribute any injury to the accused-applicant, the injured
[2026:RJ-JP:22992] (3 of 3) [CRLMB-4711/2026] sustained grievous injures but no such injuries attributed to accused-applicant; that the charge-sheet has been filed; that the accused-applicant is behind the bars since his arrest dated 09.03.2025; that the trial of the case may take considerable time, therefore, without expressing any opinion upon merits/demerits of the case, this Court deems it fit to enlarge the accused-applicant on bail. 6.
6. Accordingly, the present bail application filed under Section 483 BNSS is allowed and it is ordered that the accused-applicant Shivcharan Singh @ Shibbu S/o Late Pratap Singh, in connection with FIR No. 155/2025 registered at Police Station Jhotwara, District Jaipur (West), shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- with two attested sureties of Rs.50,000/- each to the satisfaction of the learned trial Court.
