1. The instant bail application under Section 483 B.N.S.S. has been filed by the petitioner in connection with the impugned FIR No. 402/2025 registered with the Police Station Kotwali (Dausa) District Dausa for the offences punishable under Section(s) 8/21 of NDPS Act.

Learned counsel for the petitioner submits that the accused -petitioner has been falsely implicated in this case solely on the basis of disclosure statement of co-accused from whose possession contraband article has been recovered and he has already been enlarged on bail by the co-ordinate Bench of this court; that there is one case of similar nature, is registered against the accused-petitioner. Learned counsel submits that the petitioner has been in custody since long and the trial will take its

Per contra, learned Public Prosecutor vehemently opposes the bail application but concurs with the fact that there is one case of the similar nature registered against the accused-petitioner. 4. Heard and considered the submissions made at Bar and perused the material available on record. 5. Having considered the submissions advanced by learned counsel for the petitioner, and taking into account the fact that petitioner has been falsely implicated in this case solely on the basis of disclosure statement of co-accused from whose possession contraband article has been recovered and he has already been enlarged on bail by the co-ordinate Bench of this court vide order dated 29.01.2026 passed in SB Criminal Misc. Bail Application No. 1702/2026; that there is one case of similar nature is registered against the accused-petitioner; that the accused-petitioner is behind the bars since 02.05.2026 and that the trial is likely to take considerable time for its conclusion. Hence, this Court, without expressing any opinion on the merits or demerits of the case, considers it just and proper to extend the benefit of bail to the accused-petitioner under Section 483 of the BNSS

Accordingly, the instant bail application under Section 483 B.N.S.S. is allowed and it is ordered that the accused-petitioner Juma W/o Seda @ Seduram, arrested in connection with the aforementioned FIR, may be released on bail; provided she furnishes a personal bond of Rs.50,000/- along with two surety bonds of Rs.25,000/- each to the satisfaction of the learned Trial
[2026:RJ-JP:22957] (3 of 3) [CRLMB-7686/2026] Court with the stipulation to appear before that Court on all the dates of hearing, as and when called upon to do so. 7. It is made clear that the accused-petitioner shall not involve herself in any offence(s) during currency of the bail.
In case of breach of the condition, the learned Public Prosecutor shall be free to move the application against the accused-petitioner for cancellation of the bail before the concerned Court. 8. The observation made hereinabove is only for decision of the instant bail application and would not have any impact on the trial of the case in any manner. 9.
