For the Informant : Mr. Nilesh Kumar, Advocate. ------ Order No.04 Dated- 28-04-2026 Heard the parties. The petitioner has been made accused in connection with S.T. No. 731 of 2023 Sukhdeonagar P.S. Case No. 238 of 2022 registered for the offences punishable under Sections 302, 120B, 34 of the I.P.C. and under Section 25(1-b)a, 26, 27, 35 of the Arms Act. This is the third journey of the petitioner with the prayer for regular bail, as earlier the prayer for regular bail of the petitioner was rejected vide order dated 27.11.2024 in B.A. No.6459 of 2024 and second prayer for bail of the application rejected vide order dated 01.08.2025 in B.A. No. 4157 of 2025. Learned senior counsel for the petitioner submits that the fresh ground is that in the meanwhile after rejection of the regular bail application second time on 01.08.2025 in B.A. No. 4157 of 2025. P.W.4 to 11 have been examined but none of them have stated anything to implicate the petitioner in this case. It is next submitted that the petitioner has been in custody since 21.08.2023 as mentioned in para-11 of the instant bail application and so far total 11 witnesses have been examined in this case but no material has come against the petitioner to implicate the petitioner in this case, except the deposition of P.W.1 who has only stated that the petitioner was threatening him over phone on 30.08.2022 that if his sister-in-law adduces evidence against Dablu Kujur and Rahul Kujur in the case of Kamal Bhusan, then the petitioner will kill the P.W.1., but even the P.W.1 has not stated anything to implicate the petitioner in the offence relating to murder of Kamal Bhusan. Hence it is submitted that the petitioner be admitted to bail. Learned Addl.P.P. opposes the prayer for bail of the petitioner. Considering the period of custody undergone by the petitioner, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Judicial Commissioner-III, Ranchi in connection with S.T. No. 731 of 2023 Sukhdeonagar P.S. Case No. 238 of 2022 with the condition that he will co-operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case and will not annoy or disturb the informant or witnesses of the case.
