It has been alleged that the officials of JPSC along with Sri Dhiraj Kumar, representative of M/s. Global Informatics, Ranchi had entered into criminal conspiracy among themselves and in pursuance thereof, the public servants in strict abuse of their respective official positions, dishonestly and fraudulently manipulated/allowed to manipulate the merit list, assessment charts etc. of the examination/interview to extend undue benefit to their preferred candidates. It has been submitted by the learned counsel for the petitioner that on completion of investigation CBI has already submitted charge-sheet. Learned counsel adds that some of the co-accused persons have been granted anticipatory bail vide A.B.A. No. 3349 of 2022 and its analogous cases. It has further been submitted that the petitioner was initially selected by the BPSC as Primary Teacher w.e.f. 18.10.1994 and during his -2- service period, he had obtained higher degrees and had been declared successful in JET 2006. Mr. Deepak Kumar Bharti, learned counsel for the CBI has opposed the prayer for anticipatory bail of the petitioner and has submitted that the petitioner is one of the beneficiaries to the manipulation conducted by the JPSC officials in connivance with the petitioner and in such circumstances, he does not deserve the privilege of anticipatory bail. Admittedly, the charge-sheet has been submitted by the CBI and some of the co-accused persons have been granted anticipatory bail vide A.B.A. No. 3349 of 2022 and its analogous cases.
