Petitioner has filed this petition seeking following relief (s) :- “10.1 Issue an appropriate writ, order or direction directing the respondents to grant promotion to the petitioner on the post of Assistant Office Superintendent by creating a supernumerary post in her favour, in order to protect her promotional rights in the peculiar facts and circumstances of the case, 10.2 In the alternative, issue an appropriate writ, order or direction directing the respondents to grant to the petitioner the promotional pay scale and all consequential financial benefits attached to the post of Assistant Office Superintendent, including pay protection and service benefits, without disturbing the present incumbent; 10.3 In the further alternative, direct the respondents to ensure that the petitioner shall be promoted to the post of Assistant Office Superintendent immediately upon occurrence of the next vacancy, without subjecting her to fresh uncertainty or undue delay, and with protection of her seniority and service benefits; 10.4 Issue any other appropriate writ, order or direction which this Hon'ble Court may deem fit and proper in the interest of justice, equity and good conscience;” 2. Learned counsel for petitioner submits that petitioner while working on the post of Assistant Grade-II was promoted on the post of Assistant Office Superintendent vide order dated 18.01.2017. Petitioner thereafter has joined the promoted post and was continuously working with honesty and dedication. Surprisingly on 13.06.2024, order of 3 promotion of petitioner has been cancelled. Petitioner thereafter, filed writ petition pleading therein that order of cancellation of promotion of petitioner has been passed without following due process of law and without granting him an opportunity of hearing. The order cancelling promotion was set-aside and the respondents were granted liberty to pass order afresh after granting opportunity of hearing to petitioner, thereafter, order dated 19.11.2025 (Annexure P-1) is passed. Petitioner thereafter submitted representation before the respondent No.4, which is pending consideration, therefore, direction be issued to respondent No.4 to take decision on the representation at the earliest within specified time. 3. Learned State counsel submits that he is having no objection to the limited prayer made by learned counsel for petitioner. 4. On due consideration on the submission of learned counsel for parties, this writ petition at this stage is disposed of directing respondent No.4 to consider and take decision on the representation submitted by petitioner in accordance with law expeditiously preferably within period of four weeks from the date of receipt of this order. 5.
